Participation in the University of Minnesota Duluth online resources (UMD Alumni Resources) is a privilege. By using UMD Alumni Resources, which currently consist of the UMD Alumni Directory and UMD Alumni Permanent Email & Forwarding, you agree to abide by UMD Alumni Resources Terms and Conditions of Use. By logging into either the UMD Alumni Directory or UMD Alumni Permanent Email & Forwarding, you accept the Terms and Conditions of Use as follows. If you do not accept the policies, please do not register as a user of the University of Minnesota Duluth UMD Alumni Resources.

The UMD Alumni Resources are provided by the UMD Alumni Association and are designed to facilitate communication among alumni for personal or University-related purposes only.

I. Privacy and Security

The University of Minnesota Duluth (UMD Alumni Association) and the University of Minnesota (the University) have taken all reasonable precautions to secure the personal information available through UMD Alumni Resources (which includes the UMD Alumni Directory and UMD Alumni Permanent Email & Forwarding). All alumni information is strictly guarded for use by the individual alumni and the UMD Alumni Association for University related purposes only.

UMD Alumni Resources are password protected to allow access to UMD alumni only. Although this precaution should effectively protect any personal information available through the UMD Alumni Directory from abuse or outside interference, a certain degree of privacy risk is faced any time information is shared over the Internet. Therefore, a feature of the UMD Alumni Directory provides alumni the opportunity to hide their information from being viewed by other UMD alumni.

II. Policy and Guidelines for Proper Use

To safeguard the operation of the UMD Alumni Resources, the UMD Alumni Association has adopted many guidelines and policies that are used by the University to govern conduct, particularly conduct that occurs in an online environment.

In addition to the University's policies and guidelines, users of the UMD Alumni Resources must abide by the following specific rules and regulations:

A. Unauthorized copying, reproduction, republishing, uploading, downloading, posting, transmitting or duplicating any of the material is prohibited. You may download or copy any downloadable materials displayed in the UMD Alumni Directory, for noncommercial and personal use only; provided, however, that you maintain all copyright, trademark and other notices contained in such material and you agree to abide by all additional copyright notices or restrictions contained in any material accessed through the UMD Alumni Directory.

B. Use of information or communications available through UMD Alumni Resources for any commercial, public or political purposes is strictly prohibited. Prohibited activities include, but are not limited to, solicitations for commercial services, cold-calling of any kind or mass-mailings for commercial purposes. Information available through UMD Alumni Resources may be used for specific personal and University-related purposes only.

C. Users shall not restrict nor inhibit any other user from enjoying any service on theUMD Alumni Directory. Posting of obscene materials or use of obscene language, posting of vulgar materials, or use of vulgar language, or use of abusive, defamatory, profane, or threatening language of any kind, will constitute a violation of these policies governing the use of the UMD Alumni Resources. Additionally, users shall not upload, transmit, distribute or otherwise publish any materials containing a virus or any other harmful component.

D. All aliases adopted by UMD Alumni Resources' users are subject to approval by the University and/or the UMD Alumni Association to ensure that the proper image is associated with the institution.

Neither the University nor the UMD Alumni Association is responsible for screening communications in advance, and neither the University nor the UMD Alumni Association will actively monitor the use of UMD Alumni Resources. For this reason, it is essential that the alumni users of the UMD Alumni Resources report any abuses or misuse to the UMD Alumni Association. If the UMD Alumni Association determines that a user's participation in the UMD Alumni Resources creates a liability for the UMD Alumni Association or the University or that the user has violated the policies set forth herein, the UMDalumni Association and the University reserve the right, in its sole discretion, to take actions against the user. The UMD Alumni Association reserves the right to expel a user and deny a user further access to UMD Alumni Resources if such user violates these policies or any applicable laws or regulations.

III. Liability and Indemnity

The reliability of the information available through the UMD Alumni Directory is largely dependent upon the actions of community registrants. The UMD Alumni Association can make no representations about the accuracy, reliability, completeness, or timeliness of this information.

The UMD Alumni Association does not warrant that the UMD Alumni web site will operate error-free or that the site and its server are free of computer viruses or other harmful material. To the fullest extent permitted by the law, the UMD Alumni Association disclaims all warranties, including the warranties of merchantability, non-infringement, and fitness for particular purpose. In no event shall the UMD Alumni Association or the University be liable for any damages whatsoever, including, without limitation, incidental, consequential, or punitive damages, resulting from the use of or inability to use information or materials available on the UMD Alumni Resources web site.

By using UMD Alumni Resources web site, you agree to indemnify, defend, and hold harmless the UMD Alumni Association, the University, and their respective agents from and against any and all losses, claims, damages, costs, and expenses that may arise from your use of the UMD Alumni Resources web site or your breach of these policies. The UMD Alumni Association will provide notice to you of any such action or claim, and reserves the right to participate, at our expense, in the investigation, settlement, and defense of any such action or claim.
