Laptop Checkout Agreement
University of Minnesota Duluth, College of Liberal Arts

Each student participating in the Laptop Checkout Program will be asked to sign the following agreement:

By accepting the possession of the Computer and the Software, I agree to the following. Throughout the duration of the Agreement, I shall use the Computer and the Software only in connection with my attendance at the University of Minnesota Duluth (the "University"), and shall not permit any other person to possess or use the Computer or the Software. I shall not sell, lease or otherwise grant anyone rights to the Computer or the Software. I shall adhere to the University's rules and regulations governing the use of this computer and comply with all applicable copyright and other regulations regarding the software.

I am responsible for any damage to the Computer. Upon termination of the Agreement, I must return the Computer and assorted peripherals to the Student Affairs and Advising Center, in the same condition as on the agreement beginning date, reasonable wear and tear excepted. I will be charged a fee for any needed repairs, up to $500 per occurrence, which is the insurance deductible limit imposed for the 2006-2007 calendar year. I understand that if repairs are deemed necessary to the Computer that warranty claims will first be pursued by UMD personnel and if warranty does not cover the types of repairs needed I will be liable for the costs of repairs. I realize that I am subject to criminal prosecution or civil liability and LATE FEES if I fail to return the computer by the above due date. (Initial _________). I also understand that it is my responsibility to update my student personal information if I have an address change. The web page is http://www.d.umn.edu/register/ (Initial ________). I agree to pay all fees and required repairs through my Student Financial account. (Initial _________).

THE UNIVERSITY HEREBY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES RELATING TO THE COMPUTER AND THE SOFTWARE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. I agree to accept the Computer and the Software "as is." In no event shall the University be liable to me or my guardian, personal representative, or heirs for any incidental, special, indirect or consequential damage of whatever nature arising out of any claim, whether in contract, tort or otherwise, alleging the University's failure to perform its obligations under this Agreement or its breach of any duty, common law or otherwise, owed to me.
