Trial Instructions

The materials found in this section of the site are Jury Instructions.
These are intended to be a succinct and clear statement of the law as it applies to a medical malpractice case so that the Jury can properly
understand and decide the case presented by the lawyers. The instructions are derived and distilled from decisions of Minnesota Courts decided over the course of many years. As you might imagine the law changes regularly, not so much, or so often as medicine, but enough (we hope) to keep it fair and responsive to the society that it governs. As a mirror of the law itself, Jury instructions are constantly changing and adapting to remain a fair statement of the law. This most recent version of the standard Jury Instructions was published last year.
